F. ENFORCEMENT  :  6. § 2805(c) Burden of proof
  • Beachler v. Amoco Oil Co., aff'd, 112 F.3d 902 (7th Cir. 5-1-97)

    Affirmed franchisees' request for preliminary injunction. Assignment not termination or nonrenewal. Franchisor did not have to give franchisees the opportunity to purchase stations before selling to distributors who continued the franchise relationships. Franchisees failed to satisfy threshold burden of proving termination or nonrenewal. Reliance on possibility of price and rent increases is unavailing because the dealer supply agreements with refiner do not fix prices and the franchise reserves to franchisor the option to raise rent.
