F. ENFORCEMENT  :  3. § 2805(b)(2) Preliminary injunction
  • Khorenian v. Union Oil Co. of California, 761 F.2d 533 (9th Cir. 5-21-85)

    Appellate court reversed denial of preliminary injunction finding franchisor conceded that franchisee would suffer greater hardship and finding there were sufficiently serious questions that presented fair ground for litigation including whether the personal supervision provision of the franchise was reasonable and of material significance. Therefore, its breach would be grounds for termination under this section. Franchisee was absent due to heart attack.
