Chatila v. Aranco Oil Corp., 2003 DNH 39, 2003 WL 1145501 (D.N.H. 3-13-03)

Under the plain meaning of § 2801(6)(B), a person is not a "distributor" if the person receives fuel on consignment for retail sale. The definition of distributor applies only to persons who purchase motor fuel for sale, consignment, or distribution or who receive fuel on consignment for consignment or distribution. The court held the omission of the word "sale" in the context of receiving fuel on consignment was significant and prohibited an interpretation of the word "distribution" as being analogous to sale.
