E. NOTICE  :  2. § 2804(b)(1) Less than 90 days

    Franchisor enjoined from terminating supply until 30 days after franchisee properly notified of termination. When franchisor changed the basis upon which franchisee could purchase product from credit to cash before delivery, franchisor was held to have terminated the franchise relationship. Franchisor was therefore requierd to comply with the notice provisions. Franchisor's notice (1) was not sent by certified mail or hand delivered; (2) did not state a termination date more than 90 days after delivery of the notice and (3) did not include a summary statement.
