    Affirmed franchisor's MTD and denied preliminary injunction to franchisee. That franchisor continued franchise relationship on a month to month basis after the original lease expired is all the PMPA requires. Franchisee had joined a class action against franchiser claiming among other things that the terms of written franchise were fraudulent.. Franchisor then chose to renew existing franchise rather than execute new franchise.
