A. DEFINITIONS - § 2801  :  10. Contract (10)
  • Sanna v. Friendly Service Stations, Inc., 593 F. Supp. 493 (D. Conn. 11-28-83)

Citation to definition. A PMPA franchise does not require a written contract to exist. When a signed document setting forth the terms of the parties' agreement could not be produced, the court found that there was a meeting of the minds between the parties with respect to the operation of the service stations. Plaintiff-service station operators denied preliminary injunction under the PMPA because they were found not to be franchisees as defined under the PMPA.
