C. GROUNDS FOR TERMINATION  :  4. § 2802(c) Relevant events generally  :  l. § 2802(c)(12) Conviction of any felony
  • Anderson v. Amoco Oil Co., CCH BFG 8790 (D.N.J. 2-4-87)

Franchisee's failure to operate a franchise for more than seven consecutive days and failure to devote personal attention to business was grounds for termination. The fact that police seized the marketing premises in connection with homicides committed by the franchisee after three days of closure did not excuse the closing as being beyond the reasonable control of franchisee. Franchisee had initially closed the marketing premises and police seizure is a foreseeable consequence of franchisee's acts of violence.
