Defendant #1 (property owner/lessor) and defendant #2 (lessee/sublessor/franchisor) were found to be affiliates because they had some common shareholders, officers and directors and the president of defendant #1 was a director of defendant #2 who set both the price at which #2 received product from #1 and the price at which #2 sold to franchisee.
