AM-PM Franchisee Ass'n v. Atlantic Richfield Co., CCH BFG 8803 (E.D. Pa. 10-4-85)

This section allows the franchisor to sell, transfer or assign its interest in the marketing premises to another "person" when it decides to withdraw from a market area. While the PMPA does not define "person", the court held that term is not limited to other existing franchisors. To do so, would be unlawfully restrictive under antitrust law. The term "person" simply means any individual or business entity.
