  • Drazin v. Amoco Oil Co., 1980-1 Trade Cases 63,604 (D.D.C. 10-15-80); 1981-1 Trade Cases 64,097 (D.D.C. 2-25-81)

Summary judgment for franchisor. Changes in the rent from $70-100 a month to $636-890 a month are to be judged by a "subjective" good faith standard and not "objective" good faith with the burden of proof on the question of good faith on the franchisor. The court found that the PMPA did not impose a duty to bargain the terms of the franchise, but rather a duty not to decline to renew unless, inter alia, the franchisee refuses to agree to terms which the franchisor has determined, in good faith, to put in the lease.
