    Case focused on two primary issues: (1) whether Chevron provided Plaintiff with proper notice to exercise his option; and (2) whether Plaintiff timely exercised his option. Court held the terms of the third party offer which triggered the right of first refusal were substantially similar such that Plaintiff was afforded proper notice to exercise his right of first refusal. Court further held that Plaintiff's initial exercise of his right of first refusal was not unconditional and was not timely cured. Summary judgment granted in favor of Defendants.
