  • Amoco Oil Company v. Rhode, Civ. No. 81-803 (D.N.J. 5-20-81) Consent Judgment

Franchisee notified that franchise relationship was terminated on the grounds that he failed to exert good faith efforts to carry out the provisions of the franchise. He specifically failed to maintain the property in a clean, safe and healthful manner; had numerous customer complaints; made untimely payments; and stored wrecked vehicles in violation of lease. Parties entered into a consent judgment allowing termination and giving franchisee time to sell his "blue sky."
