  • Attal v. Shell Oil Co., CCH BFG 8025 (N.J. Super Ct., Hudson Co. 6-10-83)

    State court refused to enjoin termination upon death of franchisee. The court found that § 2802(b)(C) and this section permits termination for an event relevant to the franchise relationship when termination would be reasonable. One of the franchise agreements was in the name of franchisee's wholly-owned corporation. This franchise agreement also contained a provision that permitted termination upon the death of the dealer. The court found that the parties intended that the death of the dealer meant the death of the corporation's sole shareholder.
