    CCH BFG 9534 (Pa. Ct. Com. Pleas, Bucks Co. 1-3-89)

    Summary judgment for franchisor. State common law claims of breach fiduciary duty, emotional distress, negligent misrepresentation and failure to deal in commercially reasonable manner are preempted by PMPA because they are all based on alleged wrongful termination. Grounds for termination was expiration of underlying lease. Franchisee pursued common law remedies because he filed the complaint more than one-year after termination.
