  • Naso v. Sun Refining and Marketing Co., 582 F. Supp. 1566 (N.D. Ohio 5-10-83)

    The court held that for a court to have jurisdiction under the PMPA, § 2802(a) requires the franchisor either to terminate or not renew a franchise. The court found that because the franchisor rescinded the termination notice, the franchise was never terminated or not renewed; therefore, the franchisee's lawsuit presented no justiciable controversy.
