    Summary judgment and motion to dismiss denied. The court assumed subject matter jurisdiction in order to determine whether franchisee had stated a cause of action. Franchisee claimed that because franchisor had transferred its interest in his lease to an affiliated third party which then conveyed its fee interest to other third-parties, franchisor violated the PMPA by failing to give him right of first refusal even though franchise not terminated.
