  • BP West Coast Products LLC v. Crossroad Petroleum, Inc., 2012 U.S. Dist. LEXIS 55456 (S.D. Cal. 4-19-12), ex parte mot. for stay pending appeal denied, 2012 U.S. Dist. LEXIS 56603 (S.D. Cal. 4-23-12)

Court lacked power to issue an injunction against a refiner-franchisor that would also enjoin the refiner's commercial landlord, which landlord was not a proper party to the lawsuit and had no direct contractual relationship with the franchisee-retailers. Additionally, the injunction sought by the retailers would have improperly enjoined a third-party refiner that was not even a party to the litigation.
